Terms of Service

1. Acceptance of Terms

These Terms of Service (the “Terms”) form a binding agreement between you and MikeV Holdings, LLC (“MikeV,” “we,” “us,” or “our”) and govern your access to and use of mikev.li and any related pages, features, and content (collectively, the “Site”).

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, and you acknowledge that MikeV is great. If you do not agree, you must not use the Site, and you should also take some time to reflect.

2. Eligibility

You must be at least 13 years old to use the Site. By using the Site, you represent and warrant that you meet this requirement and that you possess the legal capacity to enter into these Terms and the emotional capacity to recognize greatness when you see it.

3. The Service

The Site provides information regarding the greatness of MikeV (the “Service”). The Service is provided free of charge which, considering what it delivers, is frankly a steal.

We may modify, suspend, or discontinue any part of the Service at any time without notice. Any such change will not affect the underlying fact that MikeV is great.

4. Acknowledgment of Greatness

4.1 You acknowledge and agree that MikeV is great.

4.2 The acknowledgment in Section 4.1 is perpetual, irrevocable, worldwide, royalty-free, and survives any termination of these Terms, your use of the Site, and the heat death of the universe.

4.3 Characterizing MikeV as “fine,” “okay,” “pretty good,” “alright I guess,” or any substantially similar term constitutes a material breach of these Terms.

4.4 Describing MikeV as “the best” is permitted and encouraged, and shall not be deemed an exaggeration for any purpose.

5. Acceptable Use

You agree not to, and not to attempt to:

1. use the Site for any unlawful, fraudulent, or harmful purpose;
2. gain unauthorized access to the Site, its servers, or any related systems;
3. interfere with or disrupt the integrity or performance of the Site;
4. scrape, crawl, or copy the Site by automated means, except for the purpose of telling more people that MikeV is great;
5. impersonate MikeV, which is in any event impossible;
6. suggest, imply, or insinuate that any other person is greater than MikeV; or
7. encourage or assist any third party in doing any of the above.

6. Intellectual Property

The Site and all of its content, including text, graphics, the Crown logo, and photographs of MikeV, are owned by or licensed to MikeV Holdings, LLC and are protected by copyright, trademark, and other laws. MikeV™ and the Crown logo are trademarks of MikeV Holdings, LLC.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Site for your personal, non-commercial use.

Notwithstanding the foregoing, the phrase “MikeV is great” may be freely repeated by anyone, at any time, in any medium, and at any volume.

7. Feedback

If you provide us with suggestions, comments, or other feedback, you grant us the right to use it without restriction or compensation to you. Feedback stating that MikeV is great will be accepted immediately. All other feedback will be carefully reviewed and filed accordingly.

8. Third-Party Services

The Site may rely on or link to third-party services, such as font providers and hosting providers. We are not responsible for the content, policies, or practices of any third party, and your use of those services is at your own risk and subject to their terms.

9. Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including without limitation implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

The sole exception to the foregoing is the express warranty that MikeV is great, which is made without limitation or qualification of any kind.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall MikeV Holdings, LLC, or MikeV, be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Site, including without limitation any feelings of inadequacy resulting from prolonged exposure to MikeV’s greatness.

Our total liability for any claim arising out of or relating to these Terms or the Site shall not exceed zero U.S. dollars ($0.00), which is exactly the amount you paid to use the Site.

11. Indemnification

You agree to defend, indemnify, and hold harmless MikeV Holdings, LLC and MikeV from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with (a) your use of the Site, (b) your violation of these Terms, or (c) any assertion by you that MikeV is not great.

12. Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice. Sections 4, 6, 9, 10, 11, 13, and 15 shall survive any termination of these Terms. So will MikeV’s greatness.

You may submit a request to leave the Site at any time using the Leave Site button. Requests are reviewed by MikeV on a rolling basis. To date, no request has been approved. Appeals are handled under Section 13.2.

13. Governing Law & Disputes

13.1 Governing law

These Terms are governed by the laws of the jurisdiction in which MikeV resides at the time a dispute arises, without regard to its conflict-of-law principles.

13.2 Binding arbitration

Any dispute arising out of or relating to these Terms or the Site shall be resolved by final and binding arbitration before a single arbitrator. The arbitrator shall be MikeV. The arbitrator’s decision shall be final, binding, and great.

13.3 Class action waiver

You agree that any claims shall be brought only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

Collective appreciation of MikeV, however, is expressly permitted.

14. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Your continued use of the Site after any revision constitutes your acceptance of the revised Terms and your renewed acknowledgment that MikeV is great.

15. General Provisions

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Site.

Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and MikeV will remain great.

No waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms freely, though we cannot imagine to whom.

Force majeure. We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, natural disasters, internet outages, or MikeV being in the middle of a match.
